On this day (May 25, 1995) at 8:55 p.m., by order of the so-called general The RS army, fugitive war criminal Novak Đukić, fired a grenade at the center of Tuzla.
71 people were killed in the explosion, and more than a hundred were seriously or lightly wounded. Only a few people were over 30 years old. The youngest victim, Sandro Kalesić, was two and a half years old. On the "Youth Day", the youth of Tuzla was interrupted. We talked about this topic with Merisa Karović-Babić, scientific associate of the Institute for Research on Crimes against Humanity and International Law.
Karović-Babić stated the reasons, i.e. the entire procedure, why Novak Đukić, responsible for the massacre at the Tuzla Gate, is walking freely in Serbia.
"In 2014, the Constitutional Court of Bosnia and Herzegovina, on the basis of the appeal of Novak Đukić's lawyer, ordered that a decision be made in an urgent procedure to revise the amount of the sentence in the case of Novak Đukić. The Constitutional Court declared itself incompetent in the matter of whether Đukić should be set free to wait the final amount of the sentence or in prison. The Appellate Panel of the Court of Bosnia and Herzegovina ordered that Đukić be released in February 2014 and in April issued a verdict sentencing Đukić to 20 years in prison. The period of two months he was free was enough for the criminal Đukić to find refuge in Belgrade." - explains Karović-Babić.
He adds that the final verdict did not review the findings and conclusions of the second-instance verdict in the Đukić case, which was based on a series of evidence.
"We were only working on re-examining the amount of the sentence following the verdict of the Court of Human Rights, which said that the Court of Bosnia and Herzegovina made a procedural error, which made a decision, i.e. tried according to the law from 2003. It was a mistake. Đukić is not the only case this kind of release." - claims Karović-Babić.
